MINUTES OF THE PARISH COUNCIL MEETING
HELD ON MONDAY 11th SEPTEMBER 2006

Matters raised by the Public
Mrs H Chapman spoke on the problem of the un-adopted sewers and stated she hoped an action committee might soon be formed.
Mr Chamberlain stated he had withdrawn his development application and was present to raise the matter of flooding in his property and the need to create a diversionary ditch. He produced photographs to show flood water in his property during the June heavy rainfall. Mr Chamberlain also produced documents to show that land on the southern side at Tool Gate corner had been given to DCC in 1971 conditional upon them, within 21 years, of widening the road and creating a pavement. It was his understanding that because DCC had failed to carry out the work; the land had now reverted to him. Cllr Smith said that although he agreed there was a need to undertake flood relief work, care had to be taken to ensure that this did not adversely affect the drainage towards Patteson’s Cross and there were potential highway safety problems in widening the road. This needs to be carefully considered by the Police and Highway authorities. The Chairman said that the area under discussion was outside the parish boundary although much of the cause of the flooding problem lay within the boundary and any works undertaken would have an effect upon the residents of the parish. It was agreed to place the parish boundary on the October agenda.
Mrs Val Jones raised the matter of fly infestation and stated there was an urgent need to resolve the problem. EDDC environmental officers were to undertake inspections of local farms and it was agreed to ask EDDC for a copy of their report.
Concerns were also expressed of speeding vehicles in Green Lane. This information would be passed to the PCSO, and it was also requested that registration details of offending vehicles should be sent to the Clerk.

33. Minutes
The Minutes of the meeting held on 10th July 2006 were confirmed and signed by the Chairman.

35. Planning Matters
Applications:
06/2144/LBC Feniton Court – new kitchen and bathroom in annexe and bedroom in adjoining barn – no objections.
06/2245/TRE Fir Tree Cottage – reduce crowns of laurel and yew trees overhanging the drive – no objections.
EDDC Decisions:
06/1793/TRE Feniton House – prune back overhanging branches from access road including 6 firs, 2 cherry and 1 conifer – granted.
06/1335/FUL 06/1337/LBC Feniton Court – convert garage to holiday cottage – granted.
06/1476/FUL 93 Acland Park – erection of 2 storey side extension – granted.
06/1829/FUL 14 Acland Park – conservatory to rear – granted.
36. Police Report
PCSO Jay Bowden reported 10 crimes from July to date: 1 burglary, 2 thefts from vehicles, 3 attempted thefts from vehicles, 3 criminal damage, 1 driving whilst disqualified.
37. County and District Councillors Reports
Cllr Giles produced a written report (attached to these Minutes). It was agreed the Council would write to the Department for Transport and Mrs Angela Browning MP in support of the proposal to construct passing loops between Exeter and Axminster to improve the frequency of the service. Cllr Giles also reported he had received an application for funding from Feniton PCC and it was agreed to make a response under Late Entry Correspondence.
38. To consider the response by EDDC to the Feniton Sewers Problem
The Chief Executive of EDDC had suggested that the solution to the un-adopted sewers problem was for the residents to agree a charge be placed upon their property to enable the work to upgrade the sewers to be done. The Council considered this to be less than helpful and it was Resolved to proceed as follows:
To arrange a meeting of all interested parties, DCC, EDDC, South West Water, Environment Agency, Parish Council and residents.
To place an informatory note of the situation in the Parish Magazine.
Cllr Giles reported that the government was to release in the autumn guidelines for dealing with un-adopted sewers. Mr Chamberlain reported South West Water has a licence to discharge untreated sewage into the ditch alongside his property and that he was awaiting a report from Mr Mike baker (EDDC) on his proposals to create a relief flood ditch around his property.
39. Finance
Members took note of the satisfactory report by the Audit commission of the 2005/6 accounts.

40. Village Handyman’s Report
There was no report to make.
41. The Council’s Website
It was agreed to insert a note of the village drains problem on the noticeboard.
42. Correspondence
a. Minerals and Waste Development Framework DCC – Noted.
b. DAPC Notice of 2006 AGM – Noted.
c. CPL Petroleum – Cllr Selmes to place details on the website.
d. DCC Beautiful Days Escot 2006. It was agreed the 2006 arrangements had not been an ideal solution; concern was expressed at the closure of some public footpaths and the non-receipt of information on road management to enable details to be given to residents. It was agreed the Clerk write to DCC with the comments from the 2006 event and requesting the Council be invited to attend the 2006 debriefing session.
43. Late Entry Correspondence
a. Mr Lanning – grant from DCC for ohp equipment – it was Resolved to support the application.
b. Mr Lanning – induction of the new parish priest 31 October 2006 – noted.
c. Blackdown Hills AONB Parish Network – it was agreed the Clerk attend.
d. EDDC meeting 19th September – only the clerk was available to attend.
44. Individual Member Responsibilities
Cllr Mrs Powell said there was a need to inform the winners of the gardens and allotments competition in advance to ensure they attended the show. Cllr Mrs Powell had also received complaints of parking along Feniton Gardens and it was agreed the Clerk pass details to the PCSO. Cllr Mrs Powell also said that Colestocks road did not have a road sign, and Cllr Preston said the Green Lane sign at the eastern end had been demolished. The Clerk would advise EDDC of both matters.
Cllr Mrs Powell reported that the Coronation tree alongside Barton Rise had been chosen as one of the “great” trees of east Devon and she was asked to provide text and photographs to allow Cllr Selmes have something put on the website.
